Terms of Use
Please read these Terms of Use carefully before using www.balaganchildhood.com or purchasing any products from Balagan Childhood ("we", "us", "our", "Company"). By accessing the website or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Who We Are
Balagan Childhood is operated by two individuals based in Finland. We create and sell digital
early childhood educational materials.

2. About Our Products
We sell digital downloadable products — printable educational materials, activity packs, games, and curriculum resources for early childhood (ages approximately 0–6). Products are available as individual packs (one-time purchase) or as annual institutional subscriptions for early childhood settings (kindergartens, nurseries, preschools).
2.1 Nature of the Content
Our materials are created with the assistance of artificial intelligence (AI) tools. All AI-generated content is reviewed, validated, planned, and approved by human professionals and individuals with appropriate knowledge and expertise in early childhood education, child development, and relevant subject matter — including but not limited to educators, curriculum specialists, and subject-matter experts. The final published materials represent the considered judgment of these human reviewers.
Notwithstanding the above, all content is provided for educational and informational purposes only. We make no representation or warranty that any material is complete, error-free, up to date, or suitable for any specific educational outcome. You remain responsible for assessing the suitability of any material for your specific context, children, setting, and jurisdiction.
3. Eligibility
To purchase from us you must be at least 18 years old (or the age of legal majority in your jurisdiction) and have legal capacity to enter into binding contracts. By placing an order you represent that you meet these requirements.
Our products are intended for purchase and use by adults — parents, caregivers, and educational professionals. The materials themselves are designed for use with young children under adult supervision; children do not purchase or access the Service directly.
4. Accounts
Purchasing products requires you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@balaganchildhood.com if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts that are found to be in breach of these Terms, used fraudulently, or used in a manner that harms other users or the Company, at our sole discretion and without prior notice where necessary to protect the Service.
5. Pricing, VAT, and Payment
5.1 Prices
All prices are displayed in euros (EUR) and are exclusive of VAT unless stated otherwise. Applicable VAT is calculated and added at checkout based on your billing country, in accordance with EU VAT rules for digital services.
5.2 Payment — Private Customers
Private customers pay via Mollie B.V., our payment service provider. Mollie offers various payment methods which may include credit and debit cards, bank transfer, and other options depending on your country. The available methods are displayed at checkout and may change over time. By completing payment you agree to Mollie's terms of service. We do not store your card or bank details.
5.3 Payment — Business and Institutional Customers
Early childhood settings and other business customers are invoiced directly. Payment is by bank transfer to the bank account stated on the invoice. Invoices are due within 14 days of the invoice date unless a different term is agreed in writing. Late payments may be subject to statutory interest under Finnish law (Laki kaupallisten sopimusten maksuehdoista).
5.4 Order Confirmation
An order confirmation email does not constitute acceptance of your order. A contract is formed when payment is confirmed (for private customers) or when we issue an invoice (for business customers). We reserve the right to cancel an order before fulfilment and issue a full refund if, for example, a pricing error is identified.
6. No Refund Policy — Digital Products
All products sold by Balagan Childhood are digital content delivered immediately upon purchase. In accordance with Article 16(m) of the EU Consumer Rights Directive (2011/83/EU) as implemented in Finnish law (Kuluttajansuojalaki, Chapter 6, Section 15), the right of withdrawal (14-day cancellation right) does not apply to digital content that has been supplied and where you have given your express consent to immediate delivery and acknowledged the loss of the right of withdrawal before delivery begins.
By completing your purchase, you expressly consent to immediate delivery of the digital content and acknowledge that you lose your right of withdrawal once delivery has commenced. All sales are final. We do not offer refunds once a product has been made available for download, except where required by mandatory applicable law that cannot be excluded by agreement.
If a product is technically defective (e.g., a corrupted or inaccessible file), contact us at hello@balaganchildhood.com within 14 days and we will provide a corrected replacement file.
7. Licence to Use Our Products
7.1 Personal / Family Use (Individual Pack Purchase)
Upon confirmed payment, we grant you a non-exclusive, non-transferable, personal licence to download, print, and use the purchased materials for personal, family, or home educational purposes. You may print each item an unlimited number of times for your own household use.
7.2 Educational Setting Use (Individual Pack Purchase)
A single individual pack licence may be used by one educator within one class or group. If multiple educators in the same institution wish to use the materials, each requires their own licence, or the institution should purchase an annual institutional subscription.
7.3 Annual Institutional Subscription (Early Childhood Settings)
An institutional subscription grants a non-exclusive, non-transferable licence to all staff members of one named physical setting (kindergarten, nursery, or preschool) for the 365-day subscription period. The licence covers unlimited printing for use within that setting only. The licence expires at the end of the subscription period and must be renewed to continue use. Materials downloaded during the subscription period may not continue to be used after expiry without renewal.
7.4 What You May Not Do
The following are strictly prohibited under all licence types:
- Reselling, sub-licensing, redistributing, or sharing purchased digital files with third parties (including via email, cloud storage, social media, or any online platform).
- Modifying, adapting, or creating derivative works from our materials for redistribution or sale.
- Using our materials for commercial purposes (e.g., selling printed copies, using them in a paid workshop where participants receive them as materials) without our written consent.
- Removing, altering, or obscuring any copyright, branding, or attribution notices on the materials.
- Using our materials in any way that violates applicable law or these Terms.
- Using our materials to train, fine-tune, or otherwise develop artificial intelligence or machine learning models without our explicit written consent.
8. Intellectual Property
All content on the Service and in our products — including but not limited to text, images, graphics, designs, illustrations, layout, and compilation — is owned by or licensed to Balagan Childhood and is protected by Finnish and international copyright law and other intellectual property laws. No rights are granted except the limited licence described in Section 7.
The name "Balagan Childhood", our logo, and any associated marks are our proprietary branding. You may not use them without our prior written consent.
9. Disclaimer of Warranties
THE SERVICE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free;
- Any product will meet your specific educational, developmental, or regulatory requirements;
- The materials are suitable for every child, context, or jurisdiction;
- Any results obtained from using our materials will be accurate or reliable.
Nothing in these Terms excludes or limits warranties that cannot be excluded under mandatory Finnish consumer protection law (Kuluttajansuojalaki) where you are purchasing as a consumer.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BALAGAN CHILDHOOD, ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages;
- Loss of profits, revenue, data, goodwill, or business opportunity;
- Damages arising from your use of, or inability to use, the Service or any product;
- Damages arising from the suitability, accuracy, or completeness of any content;
- Damages arising from events beyond our reasonable control (force majeure).
Where liability cannot be excluded under mandatory law, our total aggregate liability to you shall not exceed the amount you paid for the specific product giving rise to the claim.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
11. Content Responsibility
Balagan Childhood materials are designed for educational and enrichment purposes for young children within Jewish cultural and religious traditions. We are not responsible for:
- How you choose to use, adapt, or present our materials to children;
- Any educational or developmental outcomes resulting from use of our materials;
- The interpretation of religious, cultural, or traditional content by any individual or group;
- Any injury, damage, or harm arising from activities described or suggested in our materials;
- The suitability of materials for children with specific needs, allergies, or developmental requirements — you must assess this independently.
12. Third-Party Services
The Service integrates with third-party providers including Mollie (payments), Cloudflare (infrastructure), and Scaleway (email). We are not responsible for the acts, omissions, or content of these third-party services. Your use of third-party payment services is subject to the applicable third party's terms and conditions.
Links to third-party websites are provided for convenience only. We do not endorse and are not responsible for the content, privacy practices, or availability of any external sites.
13. Acceptable Use
You agree not to:
- Use the Service in any unlawful manner or for any unlawful purpose;
- Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure;
- Use automated tools (bots, scrapers, crawlers) to extract content from the Service without our written consent;
- Introduce malware, viruses, or other harmful code;
- Circumvent any access controls or digital rights management applied to our products;
- Impersonate another person or entity or misrepresent your identity.
14. Account Termination and Licence Revocation
We may suspend or terminate your account and revoke your licence at any time if you breach these Terms, in particular Sections 7.4 and 13. If we terminate your account due to your breach, no refund will be issued. If we terminate your account for reasons other than your breach, we will provide a pro-rata refund for any unexpired subscription period.
You may close your account at any time by contacting us. Purchased licence rights terminate upon account closure. Invoice records will be retained as required by law.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Finland, without regard to conflict of laws principles.
Consumer disputes: If you are a consumer and we cannot resolve a dispute amicably, you may refer the matter to the Finnish Consumer Disputes Board (Kuluttajariitalautakunta, kuluttajariitalautakunta.fi) or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Business disputes: Any dispute between business parties shall be submitted to the District Court of Helsinki (Helsingin käräjäoikeus) as first instance.
16. Changes to These Terms
We may modify these Terms at any time. For material changes, we will notify registered users by email at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. The current version is always available at this URL.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Balagan Childhood with respect to your use of the Service and supersede all prior agreements and understandings.
